HIDUP ITU MEMBOSANKAN ATAU MEREKA ITU?

Hari ini adalah hari ke3 penulis tidak bekerja. Opted to relax and stay at home.

So, I guess I deserved to have a good break! Not much I can say about this period of relaxation except that yesterday I went for a medical checkup, which is a compulsory procedure before I join KTM (Keretapi Tanah Melayu, Jose!). It was really a pain in the a** experience!

Dan bertambah nasib baik kerana tidak ada video yang dirakamkan secara tersembunyi, otherwise it would be another controversial incident and some jerk may have to go to the UAE embassy and send a letter of apology sebab ingatkan penulis ini orang Arab! (Jose, perasan nak mampus!)

Semasa penulis sedang menulis artikel yang as usual, a self indulgent article, you may put it that way, banyak generasi muda lebih sibuk bermain dengan permainan video Half Life, dari membuat visit ke website Arkib Negara dan mencari informasi tentang sejarah negara.

P.S - The above picture were taken from Rocky's blogspot. It suits the theme of this so called article..

Ministry Lifts Ban On Export Of Monkeys

Ministry Lifts Ban On Export Of Monkeys

PUTRAJAYA, Aug 17 (Bernama) -- Malaysia has lifted the ban on the export of long-tailed macaques, better known as long-tailed monkeys, in an effort to reduce the population of these primates in urban areas, Natural Resources and Environment Minister Datuk Seri Azmi Khalid announced Friday.

"The cabinet has decided to lift the ban which was imposed in 1984 on the capture and export of this type of monkeys. This is because we want to reduce the number of long-tailed monkeys in urban areas.

"These monkeys create havoc in urban areas, not only stealing food from houses but also attacking people, and this is a cause for worry. The lifting of the ban is only for peninsular Malaysia and does not cover Sabah and Sarawak," he told a news conference at his office here.

He said the ministry had done a non-detrimental study before lifting the ban and it had been decided that only monkeys in urban areas be caught and exported.

From the study, it was found that there were 258,406 long-tailed macaques living in urban areas in peninsular Malaysia while 483,747 live in the wild in the jungles.

The long-tailed macaque or Macaca fascicularis, is a primarily arboreal macaque native to Southeast Asia. Also called the Cynomolgus Monkey, it is used extensively in medical experiments, in particular those connected with neuroscience.

It has also been identified as a possible vector for Ebola virus, monkeypox and is a known carrier of B-virus (Herpesvirus simiae). Being "ecologically diverse", the macaque is found in a wide variety of habitats, including primary lowland rainforests, disturbed and secondary rainforests, and riverine and coastal forests of nipa palm and mangrove.

It easily adjusts to human settlements and can be a pest when around farms and villages. Typically it prefers disturbed habitats and forest periphery.

Azmi said the ministry had yet to decide on the mechanism to catch these monkeys and export them and it would most likely be done through a company.

"However, the Wildlife Department will be the monitoring body. We want to make sure that long-tailed monkeys in the wild are not disturbed. We also want to ensure that monkeys caught in urban areas are not ill treated in the process of export. These monkeys still are under the endangered list of animals, so we have to do this right.

"We do not want to be accused as cruel or abusing these primates. I'm aware that there would be some opposition to this move, not only locally, but also on the foreign front," he added.

However, he said, it was not possible for all the long-tailed monkeys in urban areas to be caught and exported and it was enough if only half of them were apprehended and exported.

He said that although many people would be emotional with this decision, something had to be done to control the population of these primates in urban areas as they were becoming a menace to society.

The Wildlife Department had over the last 20 years tried to reduce the number of long-tailed monkeys in urban areas through various methods like sterilisation but none worked, he added.

He said rapid development of housing estates had caused these highly adaptable monkeys to find a living in urban areas.

Now I understand why people would like to associate bloggers with monkeys. I think it has something to do with the above. We hear that person accusing and labeling bloggers, even the former Prime Minister as monkeys, and more. What more can I say?

MENJUAL PINGAT, SEPINGGAN PENGAT (BUBUR)

Wilayah Persekutuan anugerah gelaran Datuk tahun depan?

MENJUAL PINGAT, SEPINGGAN PENGAT (BUBUR)

Oleh - Hesmel Faznee Faisal

Penulis masih tertawa, ketika menulis artikel (Jose!! Cukuplah, kau tak layak pun untuk menulis artikel!) ini. Penulis teringat sejenak tentang apa yang pernah dikatakan oleh seorang kenalan;

“Kalu hang pi jalan-jalan, hang ambik batu baling kat kepala sapa-sapa pun, mesti kena kepala Datuk!”

“Pasai apa?” Penulis tertanya dalam keadaan naïve.

Sebab lani, punyalah ramai Datuk, sapa-sapa pun buleh jadi Datuk!”.

Seperti kata Tony Montana, watak anti-hero dalam filem Scarface “All I have is my balls and I wont break it for no one!” tapi di Malaysia, apa yang tinggal?

WHAT IS THERE FOR US TO PONDER?

Laws in Cyberspace

By BHAG SINGH

Bloggers are not above the law. They can be sued or prosecuted, like anyone else.

BLOGGERS are sometimes accused of telling lies and described as rumour-mongers who can cause disharmony amongst the people and therefore cause damage to the country. To some people, it appears that there are no laws in cyber space and that the law of the jungle prevails. This is far from the truth because bloggers are certainly not above the law.

However, the laws that govern cyber space are like existing conventional laws, with some weaknesses which create difficulties in taking action against a perceived offender.

Even without the Internet, a person may make copies of offensive material and post it to numerous people without disclosing who the sender is. It may not be possible to immediately know who the author or sender is.

The same applies to bloggers who choose to remain anonymous. In such a situation, at best, one can only find out where the offensive content originated from, not necessarily who the sender is. This applies to those who attempt to keep their identity undisclosed.

However, many bloggers do not hide their identities. In which case, the situation discussed above will not be relevant nor the difficulty of identifying them be an issue.

Leaving aside the issue of identity of bloggers, the laws of the land apply with equal intensity to everyone, whether what is complained against is a verbal communication or communication through writing or the electronic medium. However, there is a difference in terms of pre-publication restraint.

The Communication and Multimedia Act 1998 specifically provides that publishers of content through this medium are not immune to action being taken against them if what is published is defamatory, seditious or in any way in breach of other specific laws.

Therefore, if anyone feels defamed by what is published on a website, he has the option of taking action against the blogger because the law clearly allows for this.

The only difference with content on the Internet is that there is no prior censorship even in the broad sense of the word. This is because section 3(2) of the Communications and Multimedia Act 1998 states that “Nothing in this Act shall be construed as permitting the censorship of the Internet”.

Therefore the only difference in the law is that those who communicate content through the Internet are not generally restrained on a pre-publication basis but remain nevertheless accountable for any wrongdoing on their part.

Of course, if someone continues to publish content that is defamatory on the Internet, it is always open to an aggrieved person to apply to the courts for an injunction to restrain such a blogger. A blogger who disobeys the injunction will have to face the usual consequences.

In fact, the law goes further when making such a blogger liable for publishing content that is defamatory, seditious or in breach of any specific law such as the Official Secret Act. The Act by Section 211(1) says that “no content application service provider, or other person using a content applications service, shall provide content which is indecent, obscene, false, menacing, or offensive in character with intent to annoy, abuse, threaten or harass any person”.

A person who does so commits an offence and is, on conviction, liable to a fine not exceeding RM50,000 or to imprisonment not exceeding one year, or both, and can be liable to a further fine of RM1,000 for every day or part of a day during which the offence is continued after conviction.

The subject of indecent or offensive material is also provided for in the Malaysian Communications and Multimedia Content Code which was registered with the Malaysian Communications and Multimedia Commission on Sept 1, 2004.

The Code identifies what is regarded as offensive and objectionable or indecent content whilst spelling out the obligations of content providers in the context of the social values of the country. This Code is administered by the Communications and Multimedia Content Forum, which acts through a Complaints Bureau whose jurisdiction is defined in the Code and the procedure regulated by the Complaint Bureau By-laws.

Where for any reason it is not possible or desired to act against the person who has originated objectionable content, the Complaints Bureau provides an option to have the content application service provider remove or cease the continued display of the content complained against.

It will be clear from this that when it comes to bloggers, it is not such a lawless area after all. The legal and regulatory mechanism, both on a self-regulatory basis and otherwise, do exist. Whether those who feel aggrieved want to exercise their rights or consider it too troublesome or, for any other reason, do not desire to pursue the matter, is left entirely to them.

The Star - ISSUES, Tuesday 14 August 2007

I took this article from The Star 14 August 2007 and reposted it in my blog for one reason; as a "microscopic" blogger, I must be responsible in whatever writings or posting that I had posted earlier on in my Bacalah blog. At the same time I would like to highlight the roles of CMCF (Communication and Multimedia Content Forum of Malaysia) in media, as well as being a content regulator body in Malaysia.

With this in mind, I would also like to inform my Bacalah blog readers (Jose, macamlah blog kau tu popular sangat!!) that 20 August 2007 would be my last day in CMCF, as lady luck is with me all the time. I got a better offer from one company (mind you, it is a GLC company!) really hope to recuperate my writing skills (Jose, as if you have one!) with plenty of nonsense written materials and the like for the blog.

Previously, I do admit I am a bit reluctant to scribble anything for my blog because of the self restraint that is bothering me down to my spine.

There are many things, which we could help to encourage people in taking up blogs as a new media of expression. In a way, blogs can help many in giving ways to disseminate their ideas or even share their train of thought with the public.

One thing which has been haunted me for many months, or maybe even years to come is the existing websites which are similar to You Tube (Jose, dia lebih kurang macam blog tapi ini video blog!). There are some which I would like to name, such as http://www.streamload.com, http://www.clipshack.com, http://www.dropshots.com, http://www.bolt.com, http://www.fluckiest.com, http://www.vimeo.com . Feel free to surf them and get a better picture about what video blog is all about.

From my personal opinion, video blogs are more dangerous and more harmful, if compared to the normal writing blogs. The normal blogs are most likely to harm a certain degree of trust in our society, i.e. towards the Government or even in our beliefs towards religion.

But video blogs can create worrisome towards the society in terms of the content available in it. Anybody can just upload their personal videos and it may likely be on sexual content related. There are many possibilities that can happen and it is about time the people, especially the Government should stop worrying so much about blogs and start educating people about the threat that can be carry out through video blogs.

Malaysians are wise enough to understand and know which side is right or wrong. They can read thousands of article available in blogs but an innocent child could easily be influenced by anything via the media (Macam video blog, Jose..)

The Government should stop worrying too much about contents of a blog and start monitoring the video blogs. Sometimes these video blogs contains insensitive content and could even harm the harmony among Malaysians. What happened to the Negarakuku video clip?

MONKEY BUSINESS IS OUT OF BUSINESS?

by- Hesmel Faznee Faisal

We are the society of monkeys, not?

We are being bred and fed with unsuccessful dreams,

The monkeys of time flies,

Across the universe of emotion,

They are bound to be brought back again to this world, per-se,

Please acknowledge the monkey's star,

Please stand up among the monkeys,

We are not the monkeys of deception,

You can leave but you will never lost in the world of monkeys,

The girl’s dream of having a monkey as her hero,

Not her fault,

Everybody are born with a monkey inside their soul,

They tend to lured out the monkey side of them,

Definition of live depend much on the monkey,

But we are not the monkey of live,

We were born separately,

And thank God we came from the same seed,

The monkey shall remain as the golden monkey,

HE shall seek the kingdom of monkey soon..

God bless the “monkey”,

Only when he became a human being…

Jaip drops case against nightclub performer

IPOH: The Perak Religious Department (Jaip) has dropped the case against singer Siti Noor Idayu Abd Moin for allegedly dressing sexily and encouraging vice by performing at a nightclub.

The 22-year-old singer said the department reached the decision after a meeting on Saturday.

“They decided to close the case because they did not have enough evidence to press charges,” said Siti Noor Idayu.

During the meeting, she said, the department officers advised her to dress properly in future performances.

However, the performer said she would continue to dress the way she always had.

“I don’t think the clothes that I wear are revealing or sexy.

“It’s not like I was wearing a two-piece (bikini). I still know what I can and cannot do,” she said yesterday.

The department detained Siti Noor Idayu and several others during a raid at a nightclub in Tambun on July 3.

Efforts to reach the department for comment failed.

By - Hesmel Faznee Faisal

The abovementioned news was taken from today’s The Star newspaper (7 August 2007). Before I go on further, I wish to note that there are many cases involving the “pihak berkuasa agama” and the latest is the controversial one against Siti Noor Idayu, a club singer who was detained on charge of her indecent dress according to the JAIP authorities.

What in the world was in their mind when they decided to detain this petite lady? How or what do they define the meaning of indecency dressing? There are many verses in the Quran which states on how one should dress, among the famous ones were Surah 7:26 - O children of Adam, we have provided you with garments to cover your bodies, as well as for luxury. But the best garment is the garment of righteousness. These are some of God's signs, that they may take heed.

Which one is more vital? Of course it is important to note that what and how we wear can create sensitivity in our society but we must also realize that the righteousness is also essential in our surrounding.

We cannot judge a person just by the wear they dress. Sometimes it is also imperative for us to look into a person’s righteousness!

The morale of the people in JAIP, obviously has been shelved. Imagine when they have to drop the case and in the course of that action, it will definitely give a bad blow for the agency and at the same time will deteriorate the true teaching of Islam; that is not to humiliate another person. Correct me if I’m wrong, but I assumed these people from JAIS must have insulted this lady with lots of accusations before they apprehended her.

Sometimes, can you notice how a tudung clad “Muslimah” lady looks upon another “Muslimah” lady who doesn’t wear decent clothing (that is the tudung) and the like? It may looked like I am stereotyping women in tudung but the fact remains there. Go and check in any of the local universities and get opinions from any Muslimah from the PMI (Persatuan Mahasiswa Islam, Jose!) association. You may understand the point that I am trying to say before you jump on with accusations that says I'm an anti pompuan pakai tudung!

What has happened in this incident should become a lesson for other “pihak kuasa agama”, not to take actions in a hasten way.

Think before you take any actions. These people calls themselves Religious Authority this, Religious Authority that, but when it comes to practicing it, they never follow according to what the Quran said. Refer to Surah 49:6 - O you who believe, if a wicked person brings any news to you, you shall first investigate, lest you commit injustice towards some people, out of ignorance, then become sorry and remorseful for what you have done.

I hope, I really hope they don’t make a fun at themselves again!

ps.- What me worry?

NOT ALL BLOGGERS ARE "GOBLOG"...

Not all bloggers are stupid, says Zam

KUALA LUMPUR: Information Minister Datuk Seri Zainuddin Maidin says not all bloggers are stupid as some of them are informative, knowledgeable and disseminate positive views on current issues.

The ones that were mostly goblok (stupid, in Indonesian) were political bloggers who float rumours and create hatred among the people, he said yesterday.

He said political bloggers “blatantly abused the freedom of the Internet.”

“Readers of these blogs read them to pass time and for fun, akin to reading a ghost story. The people must be able to distinguish between goblok bloggers and bloggers,” he added.

(The Star - 6 August 2007)

By Hesmel Faznee Faisal.

It's kind of weird to get this kind of statement from the Minister of Information. Previously, some bloggers are being bombarded with call names such as "stupid", "liars", "jobless" and the like. But now, the Minister of Information is saying that not all bloggers are stupid!

Has he seen the light at the end of the tunnel? Or maybe all this while he is playing dumb, just like what our "beloved" Prime Minister is doing all the while.

It is true however, when some said that this country, Malaysia IS a BOLEHLAND country. You can do what ever you feel you wanted to do, as long as you don't act clever as it might insult some people in the society.

Before I penned off (Jose, sebelum berhenti menulis laaa!) I attached a photo off our beloved bartender, Moe from the Simpson, together with this so called article for your pleasant view. Think about the relevant of that character with that of the Minister of Information.

Food for thought??

KERJA-KERJA PENYOKONG F**K Lah?

Oleh - Hesmel Faznee Faisal

Penulis memohon maaf.

I am terribly sorry. I couldn’t help it. I am very busy and my time was quite tied up with my new job and my new responsibilities. Working as an Operation Executive (bertanggungjawab ke atas pantauan berita dan juga blog – how ironic!) at CMCF doesn’t give a leisure for me to update my Bacalah blog.

What surprised me is that, I thought I had encountered an opposition party based website.
